Wage and Hour
A class action was filed on behalf of the managers of the cosmetics counters against a large department store chain, alleging the improper handling of commissions on returned merchandise and for failure to provide meal and rest breaks. The chain asked Bruce L. Ross & Company to assess the possible damages. The team examined commissions reports, payroll data and time clock data for a number of the chain's stores and determined the amounts that should have been paid for commissions on returns, as well as meal break penalties, rest break penalties and waiting time penalties. The matter was then referred to arbitration.
