A patent holder claimed that a national chain of dollar stores was selling a knock-off of its patented flashlight. The patent holder sued for infringement, claiming damages in an amount in excess of the revenues actually collected by the store. Bruce L. Ross & Company was hired to address the issues of disgorgement as well as reasonable royalties. Mr. Ross provided opinions regarding a reasonable royalty, stressing the economic analysis underlying the hypothetical negotiation, adjusting the result of the hypothetical negotiation for the other Georgia-Pacific factors.
