Complex Commercial Litigation
A manufacturer of fitness equipment sued its Taiwanese supplier, for payment of excess warranty costs, claiming shoddy workmanship and late deliveries. The supplier counter-sued, seeking to collect on unpaid invoices, to recover costs related to ordered and forecasted products and for interest under the contracts. Bruce L. Ross & Company was hired to calculate the supplier’s damages relating to the uncollected amounts and to analyze some of the manufacturer’s defenses. The team created sophisticated spreadsheets to analyze the outstanding invoices, the application of payments made and the calculation of interest and then substantiated amounts due by tying them to source documents. The case settled for terms favorable to the supplier.
