Complex Commercial Litigation
An automotive products company licensed a patent to a distributor, giving it territorial rights to North America. The patent holder and distributor subsequently disagreed about both contract terms and safety procedures, leading the patent holder to terminate the contract. The distributor sued to recover lost profits arising from the business interruptions it claimed resulted from the parties' disputes. Bruce L. Ross & Company prepared a report in rebuttal to the damages report submitted by the distributor's expert. At arbitration, Mr. Ross testified that the report provided by distributor's expert did not have adequate support and provided an alternative lost profits model. He also responded to several requests made by the Arbitrator. A final decision incorporated Mr. Ross’s criticisms of the work of the plaintiff's expert.
